Is a Forex VPS Tax Deductible for Traders

Is a Forex VPS Tax Deductible for Traders?

A forex VPS is a real cost of running an automated strategy, just like data feeds, charting software or a trading computer. So it is natural to ask whether you can claim it against your trading profits and reduce your tax bill.

The honest answer is: it depends on where you live and how the tax authority classifies your trading. In many countries, someone who trades as a business can deduct a VPS, while someone who trades as a personal investor usually cannot. The rules for deciding which one you are vary from country to country, and they are stricter than many traders expect.

This guide explains the key principle, how it works in the United States, the United Kingdom, Australia and India, what records to keep, and the questions to ask your accountant.

This article is general information, not tax advice. Tax rules change, and how they apply depends on your personal circumstances. Always confirm your position with a qualified tax professional in your country before claiming any deduction.

The Key Principle: Business Trader or Investor?

Almost every tax system draws a line between two kinds of people who trade:

  • Investors, who buy and sell for personal gain, usually alongside a job or other main income. Their profits are often treated as capital gains, and their running costs, such as software and subscriptions, are often not deductible, or only in limited ways.
  • Traders running a business, who trade frequently, regularly and in an organised way, often as their main activity. Their profits are usually treated as business income, and genuine business expenses, which can include a VPS, are often deductible.

Tax authorities look at your actual behaviour, not what you call yourself. Common factors include how often you trade, how long you hold positions, how much time you spend, whether trading is your livelihood, and how organised your setup is. Running EAs on a VPS can be one sign of an organised, business-like activity, but on its own it does not make you a business.

United States

Investors: generally no deduction

In the US, most people who trade from a personal account are treated as investors. Investment expenses such as software, data and subscriptions used to be deductible as miscellaneous itemised deductions, subject to a 2% of income floor. That deduction was suspended from 2018, and the One Big Beautiful Bill Act, passed in 2025, made the suspension permanent. For a typical investor, a VPS used for trading is therefore not deductible.

Traders with trader tax status: usually deductible

The IRS recognises a separate category: a trader in securities carrying on a business. According to IRS Topic 429, a trader must seek to profit from daily market movements rather than dividends, interest or long-term appreciation, and the activity must be substantial and carried on with continuity and regularity. The IRS looks at holding periods, the frequency and dollar amount of trades, whether trading is pursued to produce a livelihood, and the time devoted to it.

If you qualify, you report trading business expenses on Schedule C, and a VPS used for that business is generally a deductible expense, along with items such as data feeds, platform fees and trading software. Qualifying traders can also consider the Section 475(f) mark-to-market election, which has strict deadlines; discuss it with a tax professional.

Forex-specific rules

Forex in the US has its own tax rules (for example, Section 988 for spot forex and Section 1256 for certain futures and options contracts), which affect how your gains and losses are taxed. They do not by themselves make your expenses deductible. Whether you can deduct a VPS still depends mainly on trader tax status.

United Kingdom

Spread betting

For most UK residents, profits from spread betting are not subject to Capital Gains Tax or income tax, because spread betting is treated like gambling. The other side of that is that losses cannot be offset and costs, including a VPS, are not deductible.

CFDs and spot forex

Profits from CFD and spot forex trading are usually subject to Capital Gains Tax. For CGT, you can deduct allowable costs that are directly related to buying and selling positions, such as dealing costs. General running costs like a VPS, software or data subscriptions are not normally treated as allowable costs for CGT.

Trading as a business

In rare cases, HMRC treats trading as a trade, assessed using the badges of trade: factors such as trading as your main occupation, very frequent transactions, short holding periods and a business-like setup. Profits are then subject to income tax, and genuine business expenses, which could include a VPS, may be deductible. Most retail traders with another job are not treated this way, and the bar is high. If you think you might qualify, get specialist advice.

Australia

The Australian Taxation Office (ATO) distinguishes between share traders, who carry on a business of trading, and investors.

  • Traders declare a profit or loss as business income. Running costs such as internet, phone and computer use may be claimable, and items over $300 are depreciated rather than claimed immediately. A VPS used to run your trading business would generally fall into this kind of operating cost.
  • Investors declare capital gains and losses. Their ability to claim running costs is far more limited.

The ATO’s tests focus on factors such as the scale, frequency and organisation of your activity and whether you trade with a business plan. Keep records showing how your VPS is used in your trading activity.

India

An important legal point first

Indian residents should know that the Reserve Bank of India warns against forex trading on unauthorised platforms, and maintains an Alert List of such platforms. RBI states that residents who send or deposit money for forex transactions that are not permitted under FEMA, or on unauthorised electronic trading platforms, can face penal action under FEMA. Most offshore retail forex and CFD brokers are not authorised for Indian residents. Currency derivatives on recognised Indian exchanges are a separate, permitted route. Check that your trading is legal before thinking about deductions.

Exchange-traded derivatives

Income from futures and options trading on Indian exchanges is generally treated as non-speculative business income and reported under “Profits and Gains of Business or Profession”, usually in ITR-3. Because it is business income, expenses incurred wholly for that business, such as brokerage, internet, software subscriptions and similar costs, are commonly claimed. A VPS used only for this trading would usually be claimed in the same way. Losses can generally be set off against non-salary income and carried forward for up to eight years.

High turnover can also trigger tax audit requirements under Section 44AB. The thresholds have changed in recent years, so confirm the current rules with a chartered accountant.

Other Countries

Most other tax systems follow the same basic logic: if your trading is a business, genuine business costs are usually deductible; if it is personal investment, they usually are not. Canada, for example, distinguishes between business income and capital gains based on your trading behaviour. Wherever you live, ask your tax adviser two questions: how is my trading income classified, and are running costs deductible under that classification?

If Your VPS Is Deductible: Getting It Right

Keep proper records

  • Invoices. Download every VPS invoice from your client area. Cheap Forex VPS invoices show the plan, billing period and amount.
  • Proof of payment. Card statements or PayPal receipts that match each invoice.
  • Business use. A short note of what runs on the VPS (for example, “MT5 with three EAs for trading account 12345”). If you also use the VPS for personal tasks, you may only be able to claim the business share.
  • Trading records. Account statements that show the trading activity the VPS supports.

Watch how you pay

Many traders pay for a VPS a year or two in advance to get a lower monthly price. Our longest plans cut the price by up to half. Some tax systems let you claim a prepaid expense in the year you pay, while others spread it over the period it covers. Ask your accountant how to treat a multi-year prepayment.

Use the right expense category

Depending on your country and accountant, a VPS may be recorded as hosting, software or IT services, or computer expenses. Use the same category every year.

Does the Tax Treatment Change Whether a VPS Is Worth It?

A deduction lowers the after-tax cost of a VPS, but it should not be the main reason to buy one. A VPS earns its place by keeping your EAs online, reducing latency to your broker and cutting slippage. If those benefits do not outweigh the cost, a tax deduction will not change that.

At $5 to $15 a month for a small plan, the cost is modest either way. To weigh it up, read is a forex VPS worth it for small accounts? and how much a forex VPS costs. Our article on how latency costs traders up to $10 per lot shows the other side of the calculation.

If you trade with a prop firm, check how your payouts are taxed too: in many countries, prop firm rewards are treated differently from profits on your own account. Our guide on prop firm VPS rules covers the trading side.

Questions to Ask Your Tax Adviser

  1. Is my trading treated as a business or as personal investment?
  2. If it is a business, which running costs can I deduct, and does a VPS qualify?
  3. How should I treat a VPS paid one or two years in advance?
  4. Do I need to apportion the cost if I use the VPS for anything else?
  5. Are there special rules for forex, CFDs or prop firm income in my country?
  6. What records do you need from me at the end of the year?

Frequently Asked Questions

Can I deduct a forex VPS from my taxes?

Possibly, if your country treats your trading as a business. If you are treated as a personal investor, VPS costs are usually not deductible. Check with a tax professional.

Is a VPS deductible for US day traders?

Only if you qualify for trader tax status as a trading business. Investment expenses are no longer deductible for US investors, and that change is now permanent.

Can UK traders deduct a VPS?

Usually not. Spread betting profits are generally tax-free, so costs are not deductible, and for CFD trading under Capital Gains Tax, general running costs are not normally allowable. The exception is if HMRC treats your activity as a trade.

Is a VPS deductible against F&O income in India?

F&O income is generally treated as non-speculative business income, so expenses incurred wholly for that trading, which can include a VPS, are commonly claimed. Confirm with a chartered accountant.

What records should I keep for my VPS?

Every invoice, proof of payment, a note of what the VPS is used for, and your trading statements.

Can I claim a VPS I prepaid for two years?

In some countries the full amount is claimable in the year paid; in others it must be spread over the service period. Your tax adviser can tell you which applies.

Does Cheap Forex VPS provide invoices?

Yes. You can download invoices for every payment from your client area.
